Consent to the Storage and Processing of Personal Data

For the proper treatment of your animals and the associated billing, it is necessary to store certain personal data. We therefore ask for your consent as outlined below.

As the pet owner, I agree that the veterinary practice may store and use the following data in order to provide the best possible care:

My address
My contact details (e.g., telephone number, email address)
Data related to the treatment of my animals
Records of treatments performed and medications administered

I agree that my data may, where necessary, be shared with:

External laboratories
External service providers required for billing purposes (e.g., billing agencies)
Pet registries (e.g., TASSO)
Other veterinary practices in the event of a referral
External service providers for communication with the practice

Beyond this, my data will only be disclosed to third parties within the framework permitted by law and, where applicable, only after obtaining my further consent.

To be informed by the practice about upcoming vaccinations for my animals
To receive current information from the practice

I may request information about the scope of the stored data at any time.

I have been informed that this declaration is voluntary and may be revoked by me at any time. In such a case, any data already collected will be deleted.

Invoices that cannot be paid on-site, as well as all invoices exceeding €500, will be transferred to our billing partner ARC. By signing, I consent to a creditworthiness check in such cases.

Consent Declaration

We kindly ask for your permission to cooperate with ARC. By signing this document, you agree that we may transmit your data to ARC.

We will only transmit the data required for billing and the enforcement of claims arising from past, current, and future treatments of your animal(s). This data may include your name, address, date of birth, email address (if applicable), telephone number, treatment data and history, billing codes, and, where applicable, laboratory services and analysis results.

You also agree that, where necessary, we may provide ARC with your name, address, and date of birth before treatment or billing so that ARC can conduct a credit check based on the anticipated treatment costs. For this purpose, ARC obtains creditworthiness information from one or more credit agencies selected for the individual case (see Section 5 "Source of Data and Credit Agencies" on the reverse side). ARC also reviews whether and how any previous claims held by ARC have been settled by you.

The credit check serves solely to enable ARC to assess whether payment of the treatment costs can be expected and to determine the level of default protection ARC can provide to us. The result of this assessment will be communicated to us.

ARC will assert the above-mentioned claims in its own name against you, your insurance provider (where direct billing is possible), or any other responsible payer. By signing, you agree that these claims may be assigned to ARC and that ARC may further assign them as collateral to its refinancing bank (Sparkasse Pforzheim Calw, Poststr. 3, 75172 Pforzheim).

You hereby release both us and ARC from statutory confidentiality obligations to the extent necessary for the purposes described above. In the event of legal proceedings, ARC, as the holder of the claim, will be the party to the proceedings, and the treating veterinarian may be called as a witness.

By signing, you confirm not only your consent but also that you have received and taken note of the information provided pursuant to Articles 13 and 14 of the EU General Data Protection Regulation (GDPR).

This consent is voluntary. Your animal will be treated even if you choose not to provide this consent; in that case, we will use an alternative billing method.

You may revoke this consent and any related release from confidentiality obligations at any time with future effect by notifying either us or ARC. Upon request, we will gladly provide you with a copy of this consent declaration.

Information Pursuant to Articles 13 and 14 GDPR of ARC GmbH ("ARC")

2. Purposes of Data Processing

ARC processes and stores your personal data in order to:

Manage receivables assigned by its contractual partners (veterinarians, clinics, medical care centers, etc.) through true and non-true factoring arrangements
Enforce these claims in its own name
Conduct creditworthiness assessments
3. Legal Basis for Data Processing

Processing related to billing and assignment of claims is based on your consent pursuant to Article 6(1)(a) in conjunction with Article 9(2)(b) GDPR.

The same applies where ARC conducts credit checks prior to treatment or billing to evaluate a potential future assignment of claims.

Once ARC asserts an assigned claim in its own name, processing is carried out for the establishment, exercise, or defense of legal claims pursuant to Article 9(2)(f) GDPR.

If ARC conducts additional credit checks after billing (e.g., before initiating legal proceedings), such processing is based on Article 6(1)(f) GDPR for the legitimate interest of efficient and cost-effective debt collection.

Under Article 21(1) GDPR, you may object to such processing based on grounds relating to your particular situation. Such objections may be submitted informally to ARC.

4. Categories of Personal Data

ARC processes and stores the personal data necessary for billing and enforcement of claims, including:

5. Source of Data and Credit Agencies

The processed data is either provided to ARC by your contractual partner or collected directly by ARC during correspondence with you.

In addition, personal data such as your name, date of birth, address, previous addresses, creditworthiness information, and credit scores may be obtained from credit agencies and stored by ARC.

7. Retention Period

ARC will delete your personal data without undue delay once processing is no longer required for billing and enforcement purposes.

Where legal retention obligations apply, processing will instead be restricted (e.g., through blocking or redaction). Billing-related data generally must be retained for ten years under tax and commercial law requirements.

If other statutory or regulatory retention or deletion periods apply, ARC will comply with those requirements.

8. No Automated Decision-Making or Profiling

ARC does not carry out automated decision-making, including profiling. This means that no decision producing legal effects concerning you, or similarly significantly affecting you, is based solely on automated processing.

9. Data Subject Rights

Subject to the applicable legal requirements, you have the following rights with respect to ARC:

I certify that I am the owner of the animal and am therefore authorized to enter into a contract for the performance of any necessary treatments and surgical procedures. I further certify that I am willing and financially able to bear the costs incurred as a result.

In this context, I declare that, at the time of making this statement, I am not involved in any court-supervised debt or insolvency proceedings.

If I am not the owner of the animal, I certify that I am acting under the express authorization of the animal's owner. Should such authorization not exist, or should the owner dispute the existence of such authorization, I hereby confirm that I will be personally responsible for all costs arising from the treatment.

To the extent necessary for diagnostic purposes, I authorize you to engage third-party services (such as laboratory examinations and similar services) in my name and at my expense.

I hereby confirm that the information I have provided is accurate and instruct you to examine and/or treat my animal. I further confirm that I am authorized to do so.

I acknowledge that, following the examination of my animal, I am required to pay the resulting treatment costs by cash, debit card (EC card), or credit card. Any follow-up treatments shall also be subject to the terms of this agreement.

By signing this document, I agree to the treatment contract and to the data protection consent declaration described above for the purposes specified therein.
